Under the South African Patent Law, patent rights are awarded if the invention qualifies in terms of uniqueness – thus novelty, usefulness, and inventiveness. You may think your invention is novel, but you will only be sure once a novelty search has been conducted. Not all of us are information specialists, and as such even if we search through the patent databases, the Internet, trade journals and magazines, we may still miss a similar patent.
