Bond Transfer Cost | Bert Smith Inc | Pretoria, Gauteng

The Bond Transfer Cost Should Always Be Factored In

Because nearly every fixed property transaction requires a bond it is important to realise that for every registration of a bond with the Registrar of Deeds there will be a bond transfer cost. This applies to all bonds. Such a cost is normally the responsibility of the purchaser of the property and he or she should make sure they have factored this cost in to their budget when making an offer to purchase. There are a number of components that make up the cost including the conveyancing attorney’s fees and these costs are usually fixed in accordance with legally enforceable regulations.

Conveyancing | Bert Smith Inc | Pretoria, Gauteng

Conveyancing Is A Part Of The Legal Profession

There are many different disciplines and specialisations within the legal profession one of which is conveyancing. Conveyancers are attorneys at law who specialise in property law and the various legal requirements that are involved in fixed property transactions such as title deed transfer and bond registration. Conveyancers also are able to advise on sectional title transfers, municipal property law as well as the various issues that arise with relation to tax such as capital gains tax. Most conveyancers enter the conveyancing profession via the legal profession and either work as individuals or as part of a law firm offering conveyancing as one of its services.

The Employment Contract | S.Niselow Attorneys | Johannesburg, Gauteng

Employment Contract Termination Procedures Must Be Followed

It is imperative that the employer states the terms and conditions of employment in the employment contract. Should an employee’s actions warrant dismissal, the employer must make sure that the employment contract termination takes place according to the correct procedures in order to avoid a labour dispute and even lawsuit at the end of the day. As such we recommend that the employer from the moment of putting an employment contract on the table, keeps record of any misconduct by employees, communication about such with the employees, procedures followed regarding disciplinary hearings, and also the procedures followed in terms of the termination of the employment contract.

Bond Transfers | Bert Smith Inc. | Pretoria, Gauteng

Questions About Bond Transfers Answered

One of the frequently asked questions about bond transfers is how long such will take. To answer the question one has to understand that once both parties sign the ‘Offer to Purchase’ that a valid contract has been established. The period for bond transfers are normally calculated from the signing of the sale agreement. The seller provides the buyer a specific period in which to apply for a bond. This can be 7-14 days. The buyer must then submit all documents to the bank and there is another period of up to 21 days to have a loan approved. The financial institution approves the bond in principle, but certain conditions must be met. Once the conditions are met, the next phase takes place. In the mean time a request is placed for the cancellation figures of the seller’s bond. The bank must provide such and the buyer’s financial institution must provide guarantees. The above is just one part of the process regarding bond transfers. Only when the property transfer has taken place in totality can the process be deemed complete. As such expect from 40-90 days for the process of bond transfers to be completed.
