The Essence of a Franchise Agreement

The franchise agreement is a form of licensing contract. The licensing agreement in turn is a type of contractual relationship between two persons or entities. The one extending the license is the licensor and the one obtaining the license is the licensee. In case of a franchise agreement the franchisor has the role of the licensor and the franchisee, the role of the franchisee. This agreement provides the franchisee the right to trade under the name and brand of the franchisor. A certain image will be portrayed, procedures followed and training done. In return for the business concept and overall marketing as well as brand from the franchisor, the franchisee will pay royalties and ensure that the brand name is held in good standing.
