Both Mediation And Arbitration Can Be Used To Settle Disputes
ADR (Alternative Dispute Resolution) is the process whereby the resolving of disputes among parties happens through processes like mediation and arbitration, with the goal of avoiding court action.
Mediation and arbitration differ in several ways. Mediation involves a neutral, independent third person helping the parties find an acceptable solution, but the parties still impose the terms of settlement themselves. It is popular for resolving contractual and shareholder disputes, among others. Arbitration also involves an independent third person, but the terms of settlement are decided by the arbitrator and the arbitrator’s decision is final and legally enforceable. It is an alternate form of court with similar procedural rules.
