    If I leave my husband after 10 years, what can I hope for. I was never allowed to work, he used all the cash money I had (R43000) promised to pay it back but has never done so. Sold my car , and kept the money. He is extremely verbally abusive.

    Can someone help, I was married for 28 years, (in community of property) got divorced in Dec 2010. The lawyer handling the divorce at the time was very negligent in the drafting of the divorce agreement resulting in non of the policies or deferred pension fund which I claimed 50% of being paid out to me, it’s been almost a year now, and I had to get the help of a second attorney whom also seems to be unable to assist me as a result of legislation hampering the amendment of the divorce agreement. Apparently deferred pension funds were excluded from the legislation amendments to divorces in 2007/2008 where the “clean break” situation applies. I cannot claim the 50% from my ex husband’s deferred pension fund as a result of deferred funds being excluded from the change in this legislation. My ex husband is 55 and has already indicated that he is not taking a 1/3 lumpsum from his deferred fund. This means I will never be completely separated from him as I will have to wait until such time he does retire and then make claims against him. He does not have other assets for me to claim against. This money was supposed to help me get back on my feet. We still have a 22year old daughter at University which I support in full on recommendation of the first lawyer that I don’t claim maintenance from him for her. Can you please advise as nobody that I have approached seem to be able to give me proper advice. I have been absolutely milked for money from the lawyers I have seen so far without proper legal advice.
